Privacy Policy

Modulagent LLC ("Modulagent," "we," "us," or "our") respects your privacy. This Privacy Policy explains what information we collect, how we use it, who we share it with, and the choices you have when you use modulagent.ai or any Modulagent product.

This policy applies to the websites, applications, and services operated by Modulagent LLC, including:

• DeskLine (deskline.ai). AI-powered virtual receptionist for businesses.
• LearnIVO (learnivo.ai). AI-powered personalized learning platform.
• TextMeAndGrow (textmeandgrow.com, textly.info, and published subdomains). SMS and WhatsApp service that lets small business owners update their website and Google Business Profile by texting 1-858-398-5975.
• modulagent.ai. Our company website.

Some products have additional notices that describe product-specific practices. Where those notices exist, they supplement this policy and are linked from the product site.

• Account information such as your name, email address, phone number, business name, role, and password (hashed).
• Billing information such as the last four digits of your payment method, billing address, and tax ID where applicable. Full payment card data is handled by our payment processor and is not stored on our systems.
• Content you send us including text messages, WhatsApp messages, voice recordings, transcripts, photos, videos, documents, learning goals, study materials, business details, and instructions.
• Support messages and survey responses.

• Device and usage information including IP address, browser type, device type, operating system, referrer URL, pages visited, and timestamps.
• Message and call metadata from our telephony provider (Twilio), including timestamp, direction, delivery status, message SID, call duration, and carrier information.
• Action logs that record operations performed on your behalf, such as "updated business hours," "published photo," "generated study plan," or "answered call from +1555XXXXXXX."
• Cookies and similar technologies used for authentication, session management, security, and basic analytics. You can control cookies through your browser settings.

• Google Business Profile data that you authorize us to read or write on your behalf, used by TextMeAndGrow.
• Carrier and line-type lookups via Twilio Lookup, used to detect spam and fraud.
• Authentication providers (for example, Google sign-in) if you use them to sign in, limited to the profile fields you approve.

We use the information we collect to:

• Create your account and verify your identity, including by sending one-time codes.
• Operate the Services, including responding to calls and messages on your behalf, updating your website and Google Business Profile, and generating AI content at your direction.
• Send you transactional messages by SMS, email, WhatsApp, or voice, including verification codes, confirmations of actions you requested, reminders, service alerts, and security notices.
• Process payments, invoicing, and taxes.
• Detect, prevent, and respond to fraud, abuse, spam, and security incidents, including through rate limits, carrier checks, and blocklists.
• Debug, improve, and secure the Services.
• Comply with legal obligations and enforce our Terms of Use.
• Send you service-related announcements. We do not use your mobile number or message content to send marketing messages, and we do not share this information with third parties for their marketing purposes.

This section describes our SMS program in the form required by US wireless carriers and the Campaign Registry.

Program name: Modulagent account notifications and TextMeAndGrow service messages.

Program description: Modulagent sends SMS messages to users who have opted in, related to their account and their use of the Services. TextMeAndGrow additionally sends and receives SMS messages from business owners so they can update their website and Google Business Profile by text.

How to opt in: You opt in by providing your phone number to a Modulagent product during signup, by messaging one of our numbers (such as TextMeAndGrow at 1-858-398-5975), or by checking a consent box when prompted.

Message types: Verification codes, confirmations of changes you requested, trial reminders, subscription and billing notices, service alerts, security notices, and, for TextMeAndGrow, two-way updates related to your website and Google Business Profile.

Message frequency: Varies based on your usage. A typical account may receive a handful of messages per week. An active TextMeAndGrow account may receive more.

Costs: Message and data rates may apply. Modulagent does not charge you separately for messages, but your mobile carrier may.

HELP: Reply HELP to any Modulagent SMS for assistance, or email support@modulagent.ai.

STOP: Reply STOP to any Modulagent SMS to unsubscribe at any time. We will send one confirmation message and then stop sending non-emergency messages to that number.

No sharing for marketing: No mobile information, including phone numbers and the content of SMS or WhatsApp messages, is shared with third parties or affiliates for marketing or promotional purposes. Information sharing with subcontractors that support the Services, such as Twilio for message delivery and fraud prevention, is permitted as described in Section 5. All the above categories exclude text messaging originator opt-in data and consent; this information is not shared with any third party or affiliate for any purpose.

We share information only in the following ways.

Service providers. We share information with vendors that help us run the Services, under contract and only for that purpose. Our primary service providers are:

• Twilio (SMS, WhatsApp, voice delivery, and phone number lookup).
• Supabase and Lovable Cloud (database, authentication, and storage).
• Cloudflare (hosting, CDN, and security).
• Google (Business Profile and other APIs you authorize).
• AI model providers that we use to interpret your messages, transcribe calls, or generate content. Model providers process your content to return an output to us; they do not use your content to train their general-purpose models under our contracted configurations.
• Payment processors for subscription billing.
• Analytics and error-monitoring tools limited to operational telemetry.

Platforms you direct us to. When you ask us to publish content to your Google Business Profile, your website, or another platform you have connected, we share the content you sent for that purpose.

Legal and safety. We may share information with law enforcement, regulators, or other parties when required by valid legal process, when necessary to protect the rights, safety, or property of Modulagent, our users, or the public, or to investigate fraud or abuse.

Business transfers. If Modulagent is involved in a merger, acquisition, financing, or sale of assets, we may transfer information as part of that transaction, with notice to you where required by law.

We do not sell your personal information. We do not share personal information, and we do not share mobile phone numbers or message content, for cross-context behavioral advertising or for any third party's marketing.

We retain information for as long as your account is active and as needed to provide the Services, plus a reasonable period afterward for security, legal, tax, and accounting purposes.

Product-specific retention highlights:

• TextMeAndGrow free trial. If you do not subscribe by the end of your 30-day free trial, we unpublish your site, delete your subdomain, and soft-delete personal information on day 30. Hard deletion occurs on day 37.
• Verification codes. Deleted after use or expiration, typically within 10 minutes.
• Call recordings and transcripts (DeskLine). Retained for the retention period you configure in your account settings, with a default typically under 90 days.
• LearnIVO study materials. Retained while your account is active. You can delete individual items or your entire account at any time.
• Logs and metadata required for security and legal compliance. Retained for up to 24 months.

When we delete information, we may retain backups for a limited period and aggregated or de-identified data that cannot reasonably be linked back to you.

Depending on where you live, you may have the following rights regarding the information we hold about you:

• Access and portability. Request a copy of your information.
• Correction. Ask us to correct inaccurate information.
• Deletion. Ask us to delete your information.
• Opt-out of SMS. Reply STOP to any Modulagent SMS.
• Disconnect integrations. Revoke access to Google Business Profile or other connected accounts from those platforms' settings.
• Objection and restriction. Object to or restrict certain processing.
• Non-discrimination. We will not discriminate against you for exercising your privacy rights.
• Appeals. If we deny a rights request, you may appeal by replying to our decision email.

To exercise your rights, email privacy@modulagent.ai from the email on your account, or text "delete my account" to the TextMeAndGrow number if that is how you signed up. We may need to verify your identity before acting on a request.

California residents. Under the California Consumer Privacy Act as amended by the CPRA, you have the rights listed above. The categories of personal information we collect, the purposes for which we use each category, and the categories of recipients are described in Sections 2, 3, and 5 of this policy. We do not sell or share personal information as those terms are defined under California law. We do not knowingly collect the personal information of consumers under 16 without consent.

EU, UK, and EEA residents. Our legal bases for processing are performance of a contract with you, compliance with legal obligations, legitimate interests in operating and securing the Services, and your consent where required (for example, for non-essential cookies or marketing). You have the right to lodge a complaint with your local supervisory authority.

We use a combination of technical and organizational controls to protect your information, including:

• TLS in transit and encryption at rest for our databases and object storage.
• Role-based access control and least-privilege API keys.
• Row-level security on customer data in our application database.
• Signed webhooks for inbound events.
• Logging, monitoring, and alerting for anomalous activity.
• Security reviews of vendors that handle personal data.

No system is 100% secure. If you suspect unauthorized access to your account or to Modulagent's systems, notify us immediately at security@modulagent.ai.

The Services are intended for adults and businesses. They are not directed to children under 13, and, for LearnIVO, not directed to children under 13 without the involvement of a parent, teacher, or other authorized adult account holder. We do not knowingly collect personal information from children under 13 without verifiable parental consent. If you believe a child has provided us with personal information, contact us at privacy@modulagent.ai and we will delete it.

Modulagent is based in the United States and processes information in the United States. If you use the Services from outside the US, you consent to the transfer of your information to the US for the purposes described in this policy. We rely on appropriate safeguards for international transfers where required by law.

Some browsers offer a "Do Not Track" signal. Because there is no consistent industry standard for interpreting this signal, the Services do not respond to Do Not Track signals. You can control cookies and similar technologies through your browser settings.

We may update this Privacy Policy from time to time. Material changes will be announced by SMS to active users of messaging Services, by email to users with a verified email, or by a notice on the affected product site, and will be posted here with a new effective date. Continued use of the Services after changes take effect constitutes acceptance of the updated policy.
